Body Found in Bellevue

BELLEVUE, WI (WTAQ) - An investigation is underway after a body was found in the Village of Bellevue Saturday afternoon.

According to the Brown County Sheriff's Department, the body was found near a field on the south side of Hoffman Road around 2 p.m.

The body has not been identified and authorities say the State Crime Lab has been called in to collect evidence from the scene.

The Wisconsin Department of Justice along with the Division of Criminal Investigation and the Green Bay Police Department are also on scene.


License-less Green Bay Man Charged with OWI

GREEN BAY, WI (WTAQ) - A man from Green Bay is due in court next month for drunk driving without a license.

52-year-old Anthony D. Oliver is charged with 2nd offense OWI, 2nd offense operating with prohibited alcohol concentration and operation while revoked.

According to the criminal complaint, Green Bay police officers conducted a traffic stop in the early morning hours of February 7 in the area of Crooks Street and S. Baird Street.

One officer saw a dark colored SUV driving westbound on E. Mason Street with no headlights or tail lights on. The vehicle was swerving back and forth in its lane. As the driver made his turn to finally pull over, he appeared to hit a bunch of snow with his right front tire close to the curb.

The cop identified the driver as Anthony D. Oliver. As the officer approached the driver side door, he saw Oliver had just lit up a cigarette. Through training and experience, the officer knew it was a technique used by people to conceal the odor of alcohol from their breath.

The officer explained the reason for the stop, and Oliver responded by saying that he, "Had been having trouble with his electrical wiring lately and sometimes when he hit a bump his lights would not work." 

Oliver admitted to having one alcoholic beverage earlier that evening, and that he had just left a restaurant to drive a friend home to the west side.

An OWI patrol officer was called to the traffic stop scene. He also asked Oliver how much he had to drink before driving and he replied, "One beer." Oliver also had a piece of hard candy in his mouth, which is believed to be another way to mask the odor of booze.

The cop asked Oliver to perform some field sobriety tests, which he failed. A preliminary breath test on Oliver read a .099. Due to his prior record, Oliver had a .02 restriction on his driver's record along with an order to have an ignition interlock device installed in his car. Officers found he did not have an ignition interlock device in his vehicle. 

Oliver was arrested at that time. He was previously convicted of OWI on November 6, 2015.

Anthony D. Oliver is due back in Brown County Circuit Court on June 9 for a final pre-trial hearing. If convicted on all counts, Oliver faces up to 3 years behind bars.

Cellcom Green Bay Marathon Runs Sunday

GREEN BAY, WI (WTAQ) - Thousands of runners are taking part in Sunday's 2016 Cellcom Green Bay Marathon.

The marathon, half marathon and relay all start and end at Lambeau Field.

The marathon will affect parking, along with vehicle and boat traffic on Sunday.

The City of Green Bay says the Ray Nitschke Bridge on Main Street will not open for pleasure boats between 9 a.m. and 2 p.m.

 

Appleton Airport Offers Easier TSA Screening

GREENVILLE, WI (WTAQ) - Appleton International Airport is hosting TSA PreCheck enrollment events over the next 2 weeks starting Monday.

"We are proud to partner with TSA to offer this event for Fox Cities travelers," said Abe Weber, Appleton International Airport Director. "TSA PreCheck helps to improve the airport customer experience, not only here in Appleton, but all over the U.S."

TSA PreCheck is an expedited screening program that enables enrolled travelers to enjoy a more efficient screening experience when traveling. TSA PreCheck members don't need to remove shoes, 3-1-1 liquids, laptops, light outerwear or belts when using a TSA PreCheck lane.

Community members are encouraged to sign up for a 10-minute appointment here, but walk-in appointments are also available. 

Free parking will be available in the short-term lot for those participating in the screening. Applicants do not need to be a ticketed passenger to participate in the program. The screening will take place before security in the airport conference room across from the restaurant.

TSA PreCheck certification is $85 and is valid for 5 years. 

UPDATE: Green Bay Priest Pleads Not Guilty in Flashing Case

GREEN BAY, WI (WTAQ) - A retired priest is pleading not guilty in connection with allegations he exposed himself to a minor.

In court Monday, Rev. Richard Thomas entered that plea to 4 counts of exposing genital area to a child. Earlier this month, Thomas waived his preliminary hearing in Brown County Circuit Court.

Thomas was living in Grellinger Hall, a home for retired priests in Allouez, when he allegedly exposed himself 4 times to a 16-year-old boy while the boy walked to school in March.

According to the criminal complaint, Thomas told investigators that, "he is already seeking treatment."

Thomas is due back in court July 19. A trial date has not been set.

After the report of misconduct, the Catholic Diocese of Green Bay restricted Thomas from performing any public ministry.

Deadly Bike Crash In Kewaunee County

TOWNSHIP OF RED RIVER, WI (WTAQ) - One person is dead after a motorcycle crash in the Township of Red River, that's in Kewaunee County.

The crash happened around 9 p.m. Sunday on County Highway AB and Thiry Daems Road.

A 25-year-old Sturgeon Bay man was killed.

His name hasn't been released. The investigation continues.

Pump Price Jump Across NE Wisconsin

MILWAUKEE, WI (WTAQ) - According to GasBuddy, drivers in the Green Bay and Appleton areas were paying $2.33 per gallon on average Sunday.

That's up 9.3 cents in the Appleton area and 6.1 cents in Green Bay compared to a week earlier.

And analysts say prices may keep going up.

Greg Laskoski is a senior petroleum analyst for GasBuddy.

"With crude oil prices rallying over the past 6 weeks, reaching the highest point that we've seen since November ($48.50/ bbl.) before Friday's close, we should expect wholesale and retail gasoline prices to rise further"

Despite the recent jump at the pump, however, gas costs less than it did a year ago.

In the Green Bay area, the price is down about 34 cents per gallon compared to the price at this time in 2015.

Wisconsin DOJ Issues Response to Kutska Appeal

GREEN BAY, WI (WTAQ) - The latest appeal by Keith Kutska of his conviction in the 1992 murder of Tom Monfils should be denied.

That's according to the Wisconsin Department of Justice, who filed a 49-page motion Friday. In it, the state argues Kutska failed to prove any reasons for a new trial.

The Department of Justice summarized its arguments in 4 areas:

  • "Kutska failed to prove that he was denied the effective assistance of counsel at his trial over twenty years ago."
  • "Kutska has not adequately developed his arguments that the circuit court erroneously rejected his due process claims."
  • "Doctor Sens' newly formed opinion does not qualify as newly discovered evidence because it would not change the result of Kutska's trial."
  • "It is not in the interest of justice to vacate Kutska's conviction."

Online court records indicate that Kutska's attorneys have until June 6 reply.

Kutska, along with Michael Hirn, Michael Johnson, Dale Basten, Rey Moore, and Michael Piaskowski, were convicted of killing their co-worker at the then-James River paper mill on Green Bay's east side.

All are serving life prison terms except for Piaskowski, who was released after a federal judge overturned his conviction.

Retired Outagamie County Judge James Bayorgeon, who heard the original joint trial of the six men, will issue a ruling at some point after that.

Police: Inattentive Driving Possible Cause of Appleton Crash

APPLETON, WI (WTAQ) - A three-vehicle crash in Appleton Monday morning caused some traffic headaches.

Appleton police say it happened on northbound Highway 441 near the County Highway CE/College Avenue exit around 10:30 a.m.

According to a posting on their Twitter page, initial reports indicate that inattentive driving may have caused the crash.

Police say there were injuries, but none of them were life-threatening.

 

UPDATE: GB Police Say 'Threatening Call' Not Credible

GREEN BAY, WI (WTAQ) - Police have determined that a "threatening call" made to a Green Bay school which prompted a lock down was not credible.

Edison Middle School was put on lockdown early Monday afternoon as police worked to learn more about the call.

District officials said that no one was allowed to enter or leave the building.

Green Bay Police Chief Andrew Smith says over a half dozen officers were there and the school was on lock down for several hours.

"After a while we started to determine, through our investigation and contacting other agencies including the FBI, that this was likely to be a hoax type of call."

Just before 2 p.m., the district announced that the call was determined to not be credible and that the school would release students at the usual time.

Edison Middle School is located at 442 Alpine Drive on Green Bay's east side.

The call was similar to one received by Oakwood School near Oshkosh, police said. Janet Berry Elementary in Appleton, along with schools in Middleton and Pleasant Prairie also received threats Monday. It's not known whether the calls are connected.

TOWN OF ALGOMA, WI (WTAQ) - An elementary school near Oshkosh has been cleared by police after an evacuation Monday due to a threatening phone call.

The Winnebago County Sheriff's Department says just before noon Oakwood Elementary School in the Town of Algoma got the call. Citing the "nature of the call" and "inability to immediately determine the credibility of the threat," the sheriff's department made the decision to evacuate students and staff.

School officials say that classes will resume as normal on Tuesday.

Students and staff were taken to the 20th Avenue YMCA in Oshkosh as a precaution. Parents were asked to meet with their children there and not at the school.

Edison Middle School in Green BayJanet Berry Elementary School in Appleton, Wilson Junior High School in Manitowoc, Northside Elementary School in Middleton and Pleasant Prairie Elementary School in Kenosha County also received threatening calls. It's unknown, however, whether the calls are connected.

'Automated' Bomb Threat Called to Appleton School

APPLETON, WI (WTAQ) - School district officials in Appleton say a "short and anonymous automated phone call" about a bomb in the building put students and staff on a longer lunch break Monday.

According to the Appleton Area School District, the call was made just after 11:45 a.m. to Janet Berry Elementary School. Police were called and officers used a bomb-sniffing dog to check out the school building. 

The building was cleared around 1:40 p.m., with students and staff being allowed back inside.

The school is located at 3601 S. Telulah Ave. on the city's south side.

School leaders say other schools around the country reported receiving the same automated calls.

Edison Middle School in Green Bay and Oakwood School near Oshkosh also received threatening calls Monday, but it is unknown whether they are related.

Update: More Details Released in Karen's Pub Crash

GREEN BAY, WI (WTAQ) - More information is being released about a drunk driving crash early Saturday morning at Karen's Pub in downtown Green Bay.

The accident happened near Roosevelt and Main Streets just after midnight.

Lt. Karl Ackermann with Green Bay Police Department says the male driver hit three people as he crashed into the bar.

"He struck the curb on the west side of the street and then continued his turn presumably to go into the parking lot there, but did not turn sharp enough and instead of turning into the parking lot, he turned right into the front door of the bar.

All three people hit were taken to the hospital.

"I had heard that one of the subjects had possibly gone into surgery for an amputation. The other two victims did have substantial injuries but not to the level that would require that type of medical treatment," says Ackermann.

The driver is charged with a felony of causing great bodily harm by intoxicated use of a motor vehicle. 

He's scheduled to be in court Monday afternoon.

It's the driver's 2nd offense OWI.

Neopit Man Sentenced for Crime Spree

GREEN BAY, WI (WTAQ) - A three-year prison sentence was handed down Monday to a Neopit man for a series of crimes.

28-year-old Merwin J. Wynos was involved in a burglary at a Keshena convenience store, according to prosecutors. When an officer responded to the burglar alarm, Wynos nearly hit the officer. Wynos then led police on a high speed chase, ending when he crashed the car he was driving in Shawano County.

Wynos was also sentenced to 3 years of supervised release, while having to pay restitution to the convenience store.


Critical Injuries After Brillion-Area Crash

BRILLION, WI (WTAQ) - A crash in Calumet County Monday morning leaves one driver critically hurt.

Authorities say the crash happened on Highway 10 and Long Lake Road near Brillion at 8:27 a.m.

According to the Wisconsin State Patrol, a Toyota Rav-4 was driving eastbound on Highway 10 when it crossed the center line and struck a concrete truck driving westbound.

29-year-old Toua Hang of Manitowoc, who was driving the Toyota, was flown to a hospital with life-threatening injuries. The truck's driver, 47-year-old David Forbeck of De Pere, was taken to a hospital with non-life-threatening injuries.

A person had called police shortly before the crash saying they saw a smaller green SUV driving recklessly in the area just west of where the crash happened. 

The highway had to be closed for several hours after the crash, which remains under investigation.

BELLEVUE, WI (WTAQ) - Police say they've arrested a man in connection with a body found in Bellevue over the weekend.

Captain David Konrath of the Brown County Sheriff's Department held a news conference Monday night.

Konrath said the woman found in a field on Hoffman Road on Saturday is 31-year-old Nicole Vanderheyden of Ledgeview.

On Monday, investigators searched the area of a home on Berkley Road in Ledgeview.

Vanderheyden shared the home with her boyfriend, 34-year-old Douglass Detrie.

Officials say they arrested Detrie at his parent's home Monday and are recommending charges of first degree intentional homicide.

Investigators say they found blood located near the home and they are not looking for a weapon.

Konrath said Vanderheyden's injuries were substantial but would not reveal cause of death.

Officials believe the incident happened early Saturday morning but are not ready to reveal any details of what occurred.

Konrath says he expects investigators to be on scene at the Ledgeview home for the next few days.

Vanderheyden had three children, one she shared with Detrie.

 

 

 

 

Judge Rejects Menominee Tribe's Hemp Lawsuit

GREEN BAY, WI (WTAQ) - A lawsuit filed by the Menominee Indian Tribe concerning a hemp growing operation has gone up in smoke.

A federal judge has dismissed the lawsuit in which the tribe wanted the operation declared legal.

Tribal officials sued the federal Drug Enforcement Administration and Department of Justice last November. That's after a raid in October destroyed the hemp being grown on tribal land.

The tribe said it was growing hemp for research purposes. However, the DEA reported it confiscated 30,000 high-grade marijuana plants.

The difference between marijuana and industrial hemp is THC level. Industrial hemp has a lower THC level, preventing anyone from getting a high from it. It's used in things like clothes and building materials.

Part of the tribe's argument was that Congress allows states to grow hemp for research but the judge rejected that interpretation of the law.

"The Court denies the for declaratory relief to the effect that "State" as used in the hemp statute includes Indian tribes, and rejects the Tribe's theory that it acted as a "State" when it enacted its own law allowing hemp cultivation," wrote Judge William Griesbach.

The tribe also argued it is exempt from the state's ban on growing hemp. But the judge rejected that, too.

"Wisconsin law does not allow the growing of hemp. While Wisconsin law is not enforceable on the Menominee Reservation, that does not change the fact that the growing or cultivating of industrial hemp is not allowed under the laws of the State of Wisconsin. Because the Tribe is located in the State of Wisconsin, the hemp exception to the Controlled Substances Act does not apply to the Tribe. And having concluded that the exception does not apply in any event, it is not necessary to address the issue of whether the College of Menominee Nation is an "institution of higher education" under 5940," he added.

Appleton PD Receives National Recognition

APPLETON, WI (WTAQ) - The Appleton Police Department was recently recognized nationally for their innovative policing tactics. Chief Todd Thomas represented the department in Washington D.C. on May 13th

"We got a call about two weeks before the meeting from a gentleman at the White House who said they had seen some of our programs published in one of the law center sites and recognized it as some of the innovative stuff that they are trying encourage and push nationwide."

The briefing Thomas attended was called "Criminal Justice Reform, Community Policing, and Working with Immigrant and Refugee Communities."

Some of the policing programs they were noticed for were their Five Pillar Initiative, Summer of Service program and their stance against the proposed "sanctuary city" legislation.

But Thomas doesn't want to take any of the credit.

"It's more of an acknowledgement and recognition of the officers and those chiefs that have come before us," says Thomas.

Chief Thomas was one of 30 law enforcement leaders from all over the country, including Seattle, San Antonio, and St. Paul who attending the briefing.

Alleged Flasher Busted in Ashwaubenon

ASHWAUBENON, WI (WTAQ) - A man suspected of exposing himself to a child at an Ashwaubenon restaurant Monday night may be involved in other similar incidents.

60-year-old Randolph Lill of New London was arrested by Ashwaubenon Public Safety officers after they were called to a restaurant around 7 p.m. Monday.

Employees say a man had just left, and they believed he was a man who had exposed himself in the past. Meanwhile, a girl told officers a man had exposed his genitals to her while she was in the restaurant.

Witnesses say Lill had shorts that were slit up to the groin and he had a bandage on his leg.

Officers did not identify the restaurant.

Ashwaubenon Public Safety has released a photo of Lill and his vehicle. They are asking anyone with information or who may have been involved in a similar incident in the past two years to contact their local police department. 

Lill has not been formally charged in this case, although he could appear in court Tuesday.
