More Details In Officer Involved Shooting

APPLETON, WI (WTAQ-WLUK) - One man is dead and two others suffered non-life threatening injuries after an officer-involved shooting early Sunday morning.

Appleton Police, responding to reports of a shooting inside a bar, arrived at the Apple Pub on College Avenue and State Street just after 1:30.

One officer encountered the subject with the gun and fired his weapon at the man.

The suspect, now identified as 33 year old Jimmie Nontel Sanders, was transported to a local hospital where he later died.

Two adults, who were inside the business, were transported to local hospitals with non-life threatening injuries sustained in the incident.

Mayor Tim Hanna is praising the police response.

"When this happens, how many other places would have that many police officers right there, immediately available?"

The preliminary investigation indicates this was an isolated event with no ongoing threat to the community.

Appleton Police say that all individuals associated with this incident are accounted for and that there is no active threat to the community.

The Green Bay Police Department is now involved in the investigation due to the shooting being officer-involved.

"With the recent state law any officer involved case that results in death are required to be investigated by an outside agency," said Lt. Jeff Brester.

Teen Arrested for Allegedly Shooting Dog

GREEN LAKE COUNTY, WI (WTAQ) - A 17-year-old Cambria boy is in custody on charges that he shot and killed a dog earlier this month.  

Green Lake County officials say a 10-year-old yellow lab was reported missing in Town of Manchester on May 12.  

Investigators believe the dog was running in a field near a fence line when it was shot by a turkey hunter.  

The dog's remains were found and positively identified on Sunday. 

A Warning to Underage Drinkers and Parents

GREEN BAY, WI (WTAQ) - Graduation season is upon us and the Green Bay Police Department are warning parents, who are considering hosting underage drinking parties at their homes, to think again.

At a press conference Monday, Chief Andrew Smith says officers will be out enforcing alcohol laws.

"We have officers who are going to be going out specifically to do that...to get reports of these parties, to go there, conduct investigations and to cite underage drinkers at private parties in the city of Green Bay," said Smith.

Leaders from the Green Bay School District and Brown County Health and Human Services were on hand for the conference and joined in the conversation as well.

Associate Principal at Green Bay East High School Curt Julian says they are providing alternative activities for kids to enjoy during graduation time.

"We will be holding a senior lock-in and we've got a lot of neat activities to encourage the kids to come and do something productive in an alcohol free environment. We've been doing that for years. We have a tremendous amount of success," Julian said.

Terri Zahorik is a registered nurse for the Brown County Health and Human Services Public Health Division.

She's been working with the "Parents Who Host, Lose the Most" campaign against underage drinking for the last 2 years.

This year they are partnering with the Green Bay Police Department and the Beyond Health Brown County Alcohol Task Force.

"Alcohol misuse is a concern for our community. The public health division does a community needs assessment, and we identified alcohol misuse as one of the top 4 concerns in the community of Brown County," said Zahorik. "The youth risk behavioral survey shows that in Wisconsin 33% of adolescents drink alcohol and 15% of adolescents under the age of 13 report drinking alcohol."

Lt. Jeff Brester says community police officers recently did an operation throughout the city involving the 226 licensed establishments allowed to sell alcohol.

"Through our operation over the last couple of weeks, we've tested so far 100 out of those and out of the 100 that we tested, 14 failed and sold alcohol to underage people."

Brester has graduation safety tips for parents:

  • Make sure your child has a plan and that you know what it is.
  • Require adult supervision at every celebration your child attends.
  • Know who will be driving your child to and from the party.
  • Remind your children that, under any circumstance, you will be there to pick them up or help them.
  • Ask questions and keep in contact with your child while they are out.
  • Set a curfew and give your child rules that they must follow.
  • Communicate with other parents

Safety tips for graduates:

  • Never drink and drive! Or get in the car with anyone under the influence.
  • Remember you can always say “no” and do not have to do anything you do not want to do.
  • Be responsible.
  • Watch out for your friends and have them do the same for you.
  • Never be afraid to call your parents or a trusted adult. 
  • Share your plans for the evening with your parents, including locations and phone numbers
  • Always wear a seatbelt

In 2016, 181 minors were cited for underage alcohol violations in the city of Green Bay. 

Convicted Cop Killer Will Stay Behind Bars

MANITOWOC (WTAQ-WLUK) -The man convicted of killing a Manitowoc police officer nearly 20 years ago, won't be getting out of prison.

Law enforcement officers from several agencies filled a Manitowoc County courtroom Monday, showing their support for a fallen brother nearly 20 years later. 

"It's something that you never forget," said Cap. Larry Zimney, with the Manitowoc Police Department.

In September 1998, Jason Halda shot and killed officer Dale TenHaken during a traffic stop.

Halda was convicted of first degree homicide a year later, and sentenced to life in prison without parole. He was 17 at the time.

In January, Halda's new team, the Legal Assistance to Institutionalized Persons Project (LAIP) filed a motion asking the court to reconsider Halda's sentence, and asking for the option of parole.

LAIP argued that since Halda was a teenager at the time, the life sentence violated his constitutional rights.

"There is evidence that children don't understand and aren't developmentally at the stage in their brains where they can take in the emotional context and express the emotional context for a crime," explained Eileen Hirsch, a member of LAIP.

During Monday's hearing, Judge Mark Rohrer read excerpts from Halda's original trial, quoting the original judge, Rohrer said at the time Halda did not show any remorse and said he would've shot other officers if they had gotten in his way.

Halda's defense team says that attitude has changed.

"He has as time has gone on come to feel the remorse that he was really just to numb to feel at the time," said Hirsch. 

Halda's request for resentencing was denied, an outcome Zimney tells WLUK Manitowoc Police Officers are happy with. 

"It's something we didn't think we'd have to go through again, and to even have the thought that he would be eligible for some type of parole, that was gut wrenching" 

Halda will remain behind bars, and will not be eligible for parole. His defense team has not decided if it will appeal the ruling.

Murder Victim's Boyfriend Accused of Domestic Incident with Her Sister

BROWN COUNTY, WI (WTAQ) - A murder victim's boyfriend has been charged in a domestic incident involving her sister.

Douglass Detrie faces felony counts of Second Degree Recklessly Endangering Safety and False Imprisonment along with one misdemeanor count of Disorderly Conduct.

The 35-year-old Ledgeview man was arrested for Nicole VanderHeyden's May 2016 murder but was later released without being charged.

A Brown County judge is expected to rule next month on a motion made by George Burch, the man charged in VanderHeyden's death, to introduce evidence that shows Detrie is the 'real killer.'

Now, Detrie has been accused of a February 11 Allouez incident where he was driving in a car with VanderHeyden's sister, Heather Meyer.

Prosecutors say Detrie touched Meyer's leg in a sexual manner.

When she refused his advances, Detrie reportedly sped off and would not let her out of the car.

She could not get out of the vehicle until he stopped several miles down the road.

Meyer had been living with Detrie so she could help care for her dead sister's child.

She allegedly claimed Detrie's agression toward her had been escalating over time.

Fond du Lac County District Attorney Eric Toney has been named as the special prosecutor to handle the case. 

Detrie is scheduled to make an initial appearance June 1.  

 

Highway Crashes Leave Two Dead

OUTAGAMIE, CALUMET CO, WI (WTAQ) - UPDATE: The driver who died in the Outagamie County crash has been identified as 22-year-old Torey David Johnson of Little Chute.

One person is dead after a one vehicle crash in Calumet County Friday night.

The crash happened a little after 8 on Schmidt Road in the area of Harwood Road.

Upon arrival officials found that the vehicle had left the roadway and hit a tree.

The driver, a 20-year-old Appleton woman, was pronounced dead on the scene.

Also, died after after a single vehicle crash in Outagamie County early this morning.

The crash happened around just before 3 on Holland Road north of County Highway JJ.

Deputies say the vehicle lost control and crashed into a tree. The driver died as a result of the injuries from the crash.

Both cases remain under investigation.

Rachwal Appears in Court

MANITOWOC, WI (WTAQ-WLUK) – Sterling Rachwal made an initial appearance in Manitowoc County court Monday on charges he abused a horse.

53-year-old Rachwal faces two misdemeanor counts – disorderly conduct and intentionally mistreating an animal – for the April 29 incident at Maribel farm.

A plea date is set for July 19.

A man investigators say was Rachwal was caught on videotape assaulting a horse. He fled the scene, and later denied it was him.

Rachwal also faces misdemeanor counts in Brown County for a Feb. 17 incident.

He returns to court Tuesday for a balance of initial appearance in that case.

Beer Truck Driver Injured in Crash

BEAVER DAM, WI (WTAQ) - A 62-year-old North Carolina man has been taken to the hospital after he crashed the semi-truck full of beer he was driving.

The single-vehicle accident happened early Monday afternoon on the Highway 151 ramp at Highway G in Beaver Dam.

Investigators believe the driver failed to stop at the stop sign at the top of the 151 ramp and left the road.

The man was taken to the hospital for an unspecified injury or medical condition.

DNR officials were called to the scene for a small load of diesel fuel that may have leaked.

None of the Coors beer the truck was carrying spilled.

The ramp was closed for several hours following the crash. 


Alderman Told He Broke The Code

GREEN BAY, WI (WTAQ-WLUK) - Green Bay's ethics board has ruled Alderman Randy Scannell violated the city's code of conduct for elected officials.

Alderman Andy Nicholson filed an ethics complaint against Scannell after an incident last year involving Aldermen Tom DeWane and Chris Wery.

Nicholson says Scannell used profanity and put his finger in the chest of both Wery and DeWane. Both aldermen testified with the same stories.

“He confronted me and he said the F word and he just started poking me and I'm like baffled like what is going on?” said DeWane.

Scannell admits he acted inappropriately after being accused of basing a Colburn Pool decision on Mayor Jim Schmitt's desires.

“I lost my temper,” said Scannell. “I overreacted.”

Scannell admits to swearing at both aldermen, but says he had zero confrontation with DeWane and only incidental contact with Wery.

“We were animated, but we weren't yelling” Ironically, Scannell proposed the code of conduct for elected officials in 2015.

Scannell argues Nicholson's complaint wasn't filed in a timely manner. He also says members of the city council are supposed to handle conflict amongst themselves without involvement of the ethics board.

“The code was never designed for this committee to be a political football, to get in between two alders”

The board disagreed finding it does have authority to hear Nicholson's complaint. The board also found Scannell did violate the code of conduct and should be censured.

Afterwards, Nicholson spoke to WLUK....

“I feel that justice has been served”

The full city council now must vote on whether a censure or a different punishment is appropriate.

Scannell says he's ready...

“I’m perfectly willing to accept responsibility for what I did. If the council believes I deserve a censure, I will accept their judgement"

A censure is essentially a formal statement of disapproval. It does not mean Scannell would lose his position on the council.

Fast Track For New Rec Center

MARINETTE, WI (WTAQ-WLUK) - Plans moved forward Monday for a new community recreation center in Marinette.

A groundbreaking ceremony was held for the 114,000 square-foot space.

The site is located on Pierce Avenue across from Marinette High School.

It will include an ice arena, a turf area for sports, a walking track and meeting rooms.

There will also be a convention space, which Marinette mayor, Steve Genisot, tells WLUK there's a high demand for

"We've had a need from local corporate people saying that they need somewhere for families and corporate events, not only for the families to do with recreation"

The project costs $16.1 million.

Construction is expected to finish in spring of next year.

Court Case Moves Forward For Diaper Thieves

OSHKOSH, WI (WTAQ-WLUK) – One of the two men accused of stealing diapers from a charity’s warehouse has been convicted.

According to court records, Jason Havel will be sentenced July 13 on one count of theft after entering a no contest plea Monday.

Authorities allege Havel and John Forbes stole more than 1,700 cases of diapers.

The diapers were being stored at a Valley Packaging storage facility prior to being donated to the Fox Cities Diaper Bank, an initiative that assists low-income families with their diaper needs.

Officials say both Forbes and Havel had worked at the facility so they had knowledge of the security system.

Investigators believe Forbes and Havel had plans to resell the diapers.

Forbes is scheduled to enter a plea in the case on June 29.

That's not the end of their legal troubles.

Both men also face charges in Outagamie County for separate incidents in which they allegedly stole two forklifts.

Forbes is scheduled to enter a plea in that case Wednesday, while Havel has a final conference July 11th.

Woman In OWI Fatal Enters Plea

GREEN BAY, WI (WTAQ-WLUK) – Not Guilty.

That's the plea of the suspect in a fatal drunk driving in Brown County.

According to court records, no trial date for Savannah Dumas was set at Monday’s hearing. She returns to court July 17 for a status conference.

Also during Monday's hearing, her bond was adjusted to allow her to attend alcohol counseling, church, and go to work - but a request to attend a wedding next month was denied by the judge.

The 20 year old Dumas is charged with homicide by intoxicated use of a motor vehicle, and causing injury while under the influence for the April 19 crash which killed her passenger, 21 year old Megan Frehse.

According criminal complaint, Dumas admitted to police that she had been drinking in a bar.

The complaint goes on to say her blood alcohol level was .123 percent, which is higher than the legal limit to drive, .08.

Dumas is also under the legal drinking age.

Police say they found another woman's license in Dumas' wallet who they say looked similar to Dumas.

De Pere Police Investigating Vehicle Vandalism

DE PERE, WI (WTAQ) - Police are investigating a series of weekend vandalism in De Pere.

Officers say tires were slashed and windows were broken on several vehicles on the city's east side.

Man Sentenced for Card-Skimming Operation

BROWN COUNTY, WI (WTAQ) - A 39-year-old Florida man has been sentenced to one year in jail for placing credit card skimmers on pumps at Green Bay gas stations.

Leonardo Chacin-Paredes was convicted last month on six felony counts of Misappropriating ID Information to Obtain Money in connection with the November incidents.

Officers say Chacin-Paredes and 34-year-old Orlando Romero-Santaella gathered personal information from more than 40 people but never used any of that material for financial gain.

Romero-Santaella has a plea hearing scheduled for Friday.

 

 

Oshkosh Police Seeking Weapons Suspect

OSHKOSH, WI (WTAQ) - Oshkosh Police are looking for the 19-year-old man who they say displayed a gun during a Monday disturbance incident.

Investigators describe Lamere Milan Jr. as a 5'9" 130 pound African American male with black hair and brown eyes.

They believe Milan may be armed with the same gun used during the incident at Boyd Street and Merritt Avenue.

Milan resides in Oshkosh, and officers say he has a warrant out for his arrest for a probation violation.

Police believe Monday's incident was isolated and say there is no threat to the public.

Surprise Found in Prescription Drug Drop Box

GREEN BAY, WI (WTAQ) - Prescription drug drop boxes can be found at police departments all over the state and they are supposed to be an easy way for people to discard old or unused medications.

But last week the Green Bay Police Department found more than what they bargained for while emptying the box located in their lobby.

"The department personal that emptied the drug box, located a rolled up brown paper bag, similar to a lunch bag, inside a Ziploc bag. When they peeled the bags apart, because they wanted to determine what was inside the bag, they located a white powdery substance. That white powdery substance was later determined to be cocaine," said Captain Kevin Warych.

It ended up being around 11 grams of the drug.

"Yeah, it's a lot. When you speak to our narcotics investigators that just under half an ounce. Value wise it's approximately $500," said Warych.

He says nothing like this has ever happened before and they empty their drug box about every two weeks.

Warych says other items have been found in the container too.

"We encourage people to drop off their prescription drugs. Sadly, we've seen people drop needles in the drug box. There are warnings for people not to drop any needles and those can be disposed of at other proper locations within the city."

Ashwaubenon Public Safety Captain Jody Crocker says they've had issues in the past with syringes and liquid medicines being placed in their drug drop box...but not anymore.

"Since then our box has been modified to only except pills in singular forms, so even the bottles don't go in the containers any more.

Attorney General Brad Schimel recently announced the April 29th Drug Take Back Day was record breaking with over 66,000 pounds collected across Wisconsin.

There are 328 permanent drug disposal drop boxes located around the state.

Lockdown Lifted at Appleton Schools

APPLETON, WI (WTAQ) - The temporary lockdown at three Appleton schools has been lifted.

Lockdowns went into place around 2 pm Tuesday at St. Paul Lutheran School, Central High School, and Columbus Elementary School.

Police say there was no immediate threat to the schools, but the precaution was taken since officers were searching the area for a man experiencing mental health issues.

Law enforcement says that man has been taken into protective custody.

 

Teen Convicted in Homicide Case

WAUPACA, WI (WTAQ) - A 17-year-old Tigerton boy has been convicted of beating a man to death and leaving his body in a Clintonville-area ditch.

Zachary Hohn has pleaded no contest to one felony count of First Degree Reckless Homicide in connection with the April 2016 incident.

A felony Robbery with Use of Force charge has been dismissed but read into the record.

Hohn's sentencing is scheduled for August 25.

The other suspect, 25-year-old Adam Ozuna, will be sentenced next week.

Meth Bust in Waupaca County

WAUPACA, WI (WTAQ-WLUK) -- Nine people have been arrested in connection with a meth distribution ring in Waupaca County.

Sheriff's officials say the investigation began in February.

Eight people have so far been charged in the case:

  • Thomas E. Gill, 28, of Waupaca (released on $2,000 cash bond)
  • Melissa A. Cain, 26, of Waupaca (released on $500 cash bond)
  • Jonathan D. Neuroth, 27, Waupaca (released on $2,500 signature bond)
  • Ryan H. Williams, 30, of Waupaca (released on $500 cash bond)
  • Ashley J. Dohm, 29, of Waupaca (released on $1,000 signature bond)
  • Andrew L. Tessen, 28, of Waupaca (jailed on $5,000 cash bond)
  • Matthew A. Locadio-Alquinzon, 33, of Waupaca (jailed on $1,000 cash bond)
  • Ashley L. Buss, 27, of Waupaca (released on $1,000 signature bond)

A ninth person, 28-year-old Justin L. Hoefferle of Waupaca, was jailed on a probation hold and has not been formally charged in the case.

Authorities say, with the help of informants, undercover agents made controlled drug buys from Gill, Cain, Neuroth, Williams, Dohm, Tessen and Locadio-Alquinzon.

The purchases happened in Waupaca and in the King area.

More arrests are expected, the sheriff's office says.

Man Charged in Connection with Appleton Shooting

APPLETON, WI (WTAQ) - A 33-year-old Milwaukee man has been charged in connection with Sunday's shooting in Appleton.

Henry Nellum faces felony counts of Attempted First Degree Intentional Homicide, First Degree Recklessly Endangering Safety, and Possession of a Firearm as a Convicted Felon along with misdemeanor counts of Operating a Firearm While Intoxicated, Bail Jumping, and Disorderly Conduct.

Nellum reportedly got into a fight with Leander Moffitt at Jack's Apple Pub around 1:40 am.

The 33-year-old says he pulled a gun so he could hand it to someone else and then fight Moffitt.

The gun went off, prompting a police response that ended with Lieutenant Jay Steinke shooting and killing a man named Jimmie Sanders.

Appleton Police Chief Todd Thomas says Steinke saw a man with a gun, fired at the suspect, and killed him.

Neither Steinke nor Sanders are mentioned in the criminal complaint.

Witnesses say Nellum also pointed the gun at Moffitt's neck.

Nellum's bond has been set at $400,000.

Outagamie County District Attorney Carrie Scheneider says "we're still going through and trying to process the rest of this as quickly as we can, but we want to be as thorough as we can.  We're working with some other agencies that are outside of my control and the Green Bay Police Department's control in terms of trying to have things expedited in this as best as we can to get full and complete answers for everybody."   

A preliminary hearing is scheduled for June 30.
