Schmitt may be Sentenced Dec. 5

GREEN BAY, WI (WTAQ) - It appears that Green Bay Mayor Jim Schmitt's campaign finance case will be resolved in December.

According to online court records, a plea and sentencing hearing for Schmitt will take place at 9 a.m. on December 5. 

Schmitt's initial appearance is scheduled for Wednesday morning, where his attorney says the mayor will not attend. At that time, it was expected to allow for scheduling of that plea and sentencing hearing.

Last month, Schmitt was charged with 3 misdemeanor counts for allegedly receiving improper donations. Schmitt received a plea deal, where he's expected to plead guilty in exchange for prosecutors not recommending any jail or probation time.

WTAQ first reported the details of the Brown County Sheriff's Department's investigative report, used by Milwaukee County Assistant District Attorney Bruce Landgraf as the basis for the plea deal.


Ex: Avery Release Expected in December

UNDATED (WTAQ) - The now-former fiancée of Steven Avery says they anticipate he'll be released from prison in December.

Lynn Hartman appeared on Dr. Phil for part 2 of his sit-down interview about her relationship with Avery, who was convicted of the 2005 killing of Teresa Halbach. Avery became an international sensation after the Netflix series "Making a Murderer".

The Las Vegas legal secretary was asked about a projection of when Avery would get out of prison, to which she replied, "We're anticipating December of this year."

Hartman began writing letters to Avery after watching the Netflix series earlier this year. Those letters turned into regular phone calls and a single visit to Avery at the Waupun Correctional Institution. Then, an engagement was publicly announced.

Avery phoned into the program, which was taped last week, and spoke with Dr. Phil about his relationship with Hartman. He also asked the all-important question, "Did you kill Teresa Halbach?"

"No, I had nothing to do with it," Avery responded, before a follow-up question asking if he knows who did. "I got a hunch but I ain't certain. I can't tell you about that, not at this time anyway."

Dr. Phil asked Avery about when he would want to marry Hartman, and he said that he would like to wait until he got out of prison, but if that takes too long he would be okay with getting hitched behind bars.

Reports began surfacing this week as part one of the TV interview aired that the couple already split up. According to a Facebook post on his official family discussion page, he ended the relationship.

 

Suamico Drive-Thru

SUAMICO, WI (WTAQ) - No one was injured when a vehicle ran into a house in Brown County.

It happened shortly after 8 p.m. in the 1400 block of Riverside Drive in Suamico.

The Brown County Sheriff's Department and the Howard-Suamico Fire Department both responded.

The vehicle was removed from the home about an hour after it happened.

The damage is estimated to be around $40,000.

Authorities say the crash is still under investigation.

Back To The Drawing Board For Mall Makeover

GREEN BAY, WI (WTAQ-WLUK) - Green Bay's city council has put the brakes on a plan to redevelop East Town Mall.

In discussion of the project, all council members agree the mall could use improvement.

Alderman Guy Zima spoke to WLUK.

“I mean it's hard to believe that the location it has and the lack of competition really in the area that it isn't doing better than it has”

New Jersey developer Lexington Realty International wants to purchase the mall for a makeover.

It's proposing removing the traditional mall setup where you go inside to enter stores, and replace it a strip mall setup with only exterior entrances.

A national sporting goods store and Fresh Thyme Farmer's Market are a part of the plan.

Green Bay Mayor Jim Schmitt is a supporter of the makeover.

“We like the work they do. It's quality. They turn the facilities so you can drive up and see the stores. It's like these mini big box stores and they're good names that people on the east side and all over Green Bay are going to appreciate.”

While Green Bay's council members also expressed support for the plan, Alderman Joe Moore says the financial details need to be reworked. The current proposal calls for the city to kick in $3 million through tax incremental financing.

“I'm not even so opposed to the $3 million, but what I am opposed to is we're basing that TIF assistance off that low assessment.”

The mall is currently assessed at about $11 million. The proposed term sheet calls for that to drop to the developer’s agreed purchase price of $3.8 million.

The council unanimously agreed to send the proposal back to a committee level to renegotiate the financial details.

Crash Victim Flown To The Hospital

TOWNSHIP OF LINCOLN, WI (WTAQ) - A man sustained substantial injuries from a crash in Kewaunee County Tuesday night.

It happened near the intersection of Hawk Road, and County Highway C near Luxemburg at approximately 6:44 p.m.

Officials say a tractor pulling a self unloading wagon was travelling southbound on County Highway C when it was struck from behind by a car.

The driver of the car, a 22-year-old man from Algoma, was transported to the hospital by Eagle III Medical Helicopter.

The driver of the tractor, a 32-year-old Kewaunee man, was uninjured.

Keep Convicted Killer Locked Up

MADISON, WI (WTAQ-METRO) - The office of Wisconsin Attorney General Brad Schimel wants to keep Brendan Dassey in custody despite his conviction for a 2005 murder being overturned.

Dassey and his uncle, Steven Avery, were found guilty of the murder of photographer Teresa Halbach in Manitowoc County, and their case was turned into the Netflix documentary "Making a Murderer," which prompted calls for them to both be released.

Schimel's office has filed a response to Dassey's request to be freed while the state appeals the overturning of his conviction.

In the response, state lawyers argue keeping him locked up is in the best interest of the public and the victim's family.

Wrongly Convicted Man Walks Free

GREEN BAY, WI (WTAQ) - A Milwaukee man who has served 24 years in prison for two counts of first degree sexual assault has been released from the Green Bay Correctional Institution.

48-year-old Daryl Holloway was sentenced to 120 years in prison after being found guilty in 1993.

The co-director of the Wisconsin Innocence Project says that new DNA evidence proved Holloway was not responsible for the crime.

A Milwaukee County judge vacated Holloway’s conviction Tuesday and dismissed all charges.

Not Guilty Plea in Schmitt Case

GREEN BAY, WI (WTAQ) - The attorney for Green Bay Mayor Jim Schmitt entered a plea of not guilty during Wednesday morning's initial appearance to three counts of violating state election finance laws.

Attorney Patrick Knight was in Brown County Court where a plea and sentencing hearing for December 5th at 9 a.m. was scheduled. This not guilty plea is a formality as it's been publicly acknowledged that a plea deal has been reached in the case.

It was announced last month that the deal requires Schmitt to plead guilty to the 3 misdemeanor counts and give up over $26,000 in his campaign fund. Prosecutors will then not recommend any jail or probation time.

Schmitt was not required to appear at Wednesday's hearing and did not. However, vocal long-time critic and Green Bay Alderman Guy Zima did show up. Afterward, Zima told the media that he's disappointed Schmitt's case won't be resolved until at least December.

“One way or another there is a number of us that are going to seek justice, because it’s a mockery of the justice system really to take these serious charges and reduce them to misdemeanors,” said Zima.

Schmitt told FOX 11 he would rather have had the case resolved Wednesday morning instead of waiting until December. Schmitt maintains he won't resign and has declined to provide interviews on the campaign allegations until the case is resolved.


NTSB Releases Initial Report on Plane Crash

UNDATED (WTAQ) - A prelimnary report about the fatal plane crash in Door County in September 18 has been released.

16-year-old Olivia Dahl and 69-year-old Ralph Keller died in the crash.

The preliminary report by the National Transportation Safety Board does not indicate what may have caused the plane to hit trees and crash. It states:

"On September 18, 2016, about 2032 central daylight time, a Cessna 182T airplane, N2012F, impacted terrain during a visual approach to the Ephraim-Gibraltar Airport (3D2), Ephraim, Wisconsin. The pilot and student pilot were fatally injured and the airplane was destroyed. The airplane was registered to and operated by Keller Aviation LLC under the provisions of 14 Code of Federal Regulations Part 91 as a personal flight. Night visual meteorological conditions prevailed for the flight, which departed from Green Bay-Austin Straubel International Airport (GRB), Green Bay, Wisconsin on an instrument flight rules (IFR) flight plan at 2003.

According to friends of the pilot, he ferried the student pilot from 3D2 to GRB so she could take a flight lesson. On their return flight from GRB, the pilot cancelled IFR at 2024 during the descent into 3D2. About 3,500 ft prior to the Runway 14 threshold, the airplane impacted 50 ft high trees. The airplane came to rest about 210 ft beyond the initial tree strike and a post-crash fire ensued."

A community celebration of life service for Dahl will be held on October 23 at Shepherd of the Bay Lutheran Church in Ellison Bay at 3 p.m.

Motorcycle Rider, 14, Hits Police Car

NEENAH, WI (WTAQ) - Neenah police are requesting juvenile charges against a 14-year-old boy who crashed his motorcycle into a marked squad car during a chase.

Officers attempted to stop the motorcycle near the corner of Tullar Road and Breezewood Lane around 6:30 p.m. Tuesday. The boy drove away to the east and headed into an industrial area. 

Police then say the boy drove through Southview Park and across lawns and into an apartment complex on the corner of Commercial and Bell streets. He then struck the squad car while circling the apartment complex.

The boy, who was wearing a helmet, suffered minor injuries and was taken to the hospital. He later was released to the custody of a parent. 

The Winnebago County Sheriff's Office has been requested by Neenah police to investigate.

WATCH: I-41 Project Ribbon Cutting

GREEN BAY, WI (WTAQ ) - The end of the Brown County I-41 Project is near completion.

Wednesday the Wisconsin Department of Transportation and a number of elected officials, celebrated the fulfillment of the last of nine interchanges rebuilt as part of the project.

A ribbon cutting ceremony took place along the Velp Ave. exit.

Wisconsin DOT I-41 Program Manager, Tom Buchholtz, attended the event and says it's a huge accomplishment and folks won't have to wait much longer to use the Velp interchange.

"It will open late Sunday. Drivers will really see the speed limit signs change into the next week. It should be barrel-free by early November for both directions and 70 mph."

All southbound I-41 lanes south of Mason Street will be done before the weekend, opening to traffic on Friday.

Plans for the construction project began in 1999 but the Brown County portion started in 2010.

WisDOT NE Region Deputy Director, Colleen Harris, says she couldn't be more excited about the completion the project.

"Trust me, the benefits of this project will make up for the last few years of inconvenience. It's a huge project. It takes a lot of time and involvement to complete a project this magnitude."

Lt. Governor Rebecca Kleefisch was the keynote speaker, with Green Bay Mayor Jim Schmitt, Brown County Executive Troy Streckenback, Oneida Nation Tribal Charwoman Christina Danforth, and Greater Green Bay Area Chamber President Laurie Radke all taking to the podium.

The project will be finished by early November and under budget in excess of $50 million.

The original estimated cost for the I-41 Project is $1.5 billion.

WATCH: Sanders Stumps for Clinton

GREEN BAY, WI (WTAQ) - Vermont Senator Bernie Sanders spoke at an early vote rally in Green Bay Wednesday, urging supporters to back Democratic presidential nominee Hillary Clinton.

Sanders, who knocked off Clinton in April's primary in Wisconsin, spoke for about 40 minutes on a number of issues which he and the former Secretary of State have agreed upon.

"What Secretary Clinton has proposed is making every public college and university in America tuition-free for families earning $125,000 or less," says Sanders in referencing one of his core issues. "That is a big deal."

Sanders also says the Democratic ticket will do something to repair many of the problems facing the nation, like climate change, economic and racial inequality along with keeping corporations from running elections and Washington D.C.

"She said that I should tell you that within the first 100 days of her administration, she will submit a constitutional amendment to overturn Citizens United," Sanders said, hitting home the message of the 2016 election being the most important of our lifetime. "You don't like Hillary Clinton fine...you don't like Donald Trump fine. That's not important. What is important is what's going to happen to you and your kids and your parents over the next four years."

Several hundred supporters began lining up nearly an hour before the doors to the Ray and Joan Kroc Center opened at 3:45 p.m. 

Many of them didn't feel slighted that Sanders, and the previous week Chelsea Clinton, have come to Green Bay but not the actual nominee.

"We have to be realistic and understand that she can't be everywhere," says one supporter Kate. "She needs people to do these kinds of things for her."

"I'd rather see Clinton in the states she could genuinely lose," remarked David, who feels Hillary Clinton has Wisconsin locked up. "I think she will win the general election but I think a lot of that rides on her being in Florida, Ohio and Pennsylvania."

Man Accused of Attacking Fiancée

GREEN BAY, WI (WTAQ) - A Green Bay man is facing multiple charges following a domestic violence incident this summer.

31-year-old William D. Fate is charged with seven counts, including 3 felonies for second-degree recklessly endangering safety, strangulation and suffocation as well as false imprisonment.

According to the criminal complaint, Green Bay police were called to an apartment in the 900 block of N. Webster Avenue around 1:40 p.m. on August 11 for a report of a man and woman physically fighting.

Officers arrived to find a man without a shirt on the front law with a pocket knife clipped to his right pocket. He was quickly handcuffed and claimed the woman, "tried to kill herself." He was later identified as William D. Fate.

Next door, the woman was found by an officer on the back porch crying. She looked to have several physical injuries and allegedly told the cop that he, "beat the s*** out of me." The victim also said her son saw the whole thing.

A woman living at that address and her roommate told officers that the couple moved in two weeks ago and that, "they fight and argue all the time." 

The two witnesses, according to the complaint, went over to their home and headed into the basement where Fate was. Fate was seen with a, "rope around his neck and a knife in his hand." That's when they went back to their house and called police.

Fate, who was animated, agitated and shaking, told officers that he, "was autistic and unable to sit down." He told officers that the victim is his fiancée and had, "threatened to take all of her prescription pills." 

That led to the argument, which Fate claims he told her that he's a, "piece of s*** from South Carolina," and just wanted to end his life. He also said he was, "sick of it all", took a rope and tried to hang himself in the basement. Police did notice a very distinct red line around his neck.

The victim told police, per the complaint, that during the verbal argument Fate physically assaulted her and that her son came out of his room and saw it. She yelled at him to go back into his room because, "she was worried what William would do to him."

Fate was taken to a local hospital for evaluation, and continued to act agitated. Officers say he was pacing back and forth, making references that he wanted to come after the officer, "so that he could try to make me shoot him."

William D. Fate remains in the Brown County Jail on a $7,500 bond. Fate returns to court on November 14 for a status conference. If convicted of all counts, Fate faces nearly 25 years in prison.

Crime Victim Receives What's Rightfully Hers

GREEN BAY, WI (WTAQ-WLUK) - The Brown County Clerk of Courts and the Sheriff's Department came together to find a local woman who was owed restitution.

Three months ago, officials were notified of a large amount of money sitting in restitution for a woman named Amanda Bricker.

Bricker was the victim of a hit-and-run crash in 2007.

After extensive searching, Bricker was finally found.

On Wednesday, officials presented her with a check for $13,000.

Bricker says she's thankful officials didn't give up in their search for her.

"Crazy. Very shocked. Surprised. Happy. I mean, $13,000 is a lot of money, so very excited. Very excited."

Bricker says when it comes to the money, it was "out of sight, out of mind."

She says she's going to put it away for a rainy day.


Klemz Committed to Mental Health Facility

OSHKOSH, WI (WTAQ) - A man charged with trying to kill two law enforcement officers late last year was convicted, but then found not guilty by reason of mental disease or defect.

Court records indicate that 58-year-old Richard Klemz was committed to a mental health facility for 80 years. Klemz also wrote letters of apology to the officers involved.

The charges against Klemz stems from a December 10 incident, which led to officers shooting him outside the Algoma town hall near Oshkosh. Officials say that it began when Klemz threatened to hurt himself and used a knife and hammer to damage property.

Klemz's plea hearing was scheduled for Friday, but during a hearing last week Klemz entered an Alford plea to the two counts of attempted first-degree intentional homicide. An Alford plea means he maintains his innocence but acknowledges the state has enough evidence to convict him.

After reviewing psychological reports, Winnebago County Judge John Jorgensen declared Klemz not guilty by reason of mental disease or defect at a hearing on September 28. Klemz was committed to a mental health facility for 40 years for each attempted homicide count.

Four other charges were dismissed by Jorgensen.

While Klemz' attorney previously said he suffered from amnesia, Klemz described his mental condition more in apology letters written to Oshkosh Police Officer Robert Kraemer and Winnebago County Sheriff's Deputy Kyle Schoonover.

"I don't remember anything about that day, or the 4 days prior to that day. I have been suffering severe and persistence depression for a long time, I hope you and your dog were not hurt," Klemz's handwritten note to Schoonover says. "Even now after all this time and seeing the video, nothing has triggered any memeries (sic) of that day... I just want to put this all behind me and get the mental help I need."

In the letter to Kraemer, Klemz said he had been seeking help for months.

"I hope you can accept my apology," he wrote.

3 Teens Arrested for Vehicle Thefts

OSHKOSH, WI (WTAQ) - Police in Oshkosh say three teens have been arrested in connection with a number of vehicles thefts in September.

The arrests, police say, stem from an investigation into 4 vehicles being stolen between September 1 and September 12. Back on September 13, officers revealed that 9 vehicles had been stolen that month, seven of them with keys inside with the door unlocked.

Since then, police say 4 more vehicles have been taken.

Two 18-year-old Oshkosh men are having charges referred to the district attorney's office. A 16-year-old Neenah boy is being referred to juvenile authorities.

The Oshkosh Police Department is again reminding drivers not to leave keys inside vehicles and to lock vehicle doors when they are parked.

Packers-Giants Travel Advisory Issued

GREEN BAY, WI (WTAQ) - Fans planning on heading to Lambeau Field for Sunday night's Green Bay Packers game will have some construction impacts going to and from the game.

Despite a ribbon-cutting ceremony Wednesday for the conclusion of the Interstate 41 project, lanes on the span remain closed. That will impact traffic coming from the Milwaukee area, since the game against the New York Giants is a gold package game.

According to the Wisconsin DOT, there could be traffic backups on I-41, I-43 and Highway 172, as well as the I-41 interchanges at Lombardi Avenue, Oneida Street, Highway 172 and I-43. There will also be heavy traffic on Ashland Avenue in De Pere and Ashwaubenon.

The heaviest congestion is expected for 3 hours before and after the game. Kickoff is set for 7:30 p.m.

Here is the DOT's outlook for traffic in the Green Bay area:

I-41/Velp Avenue Interchange

Brown County

  • Full closure of I-41 entrance and exit ramps at Velp Avenue
  • Full closure of Velp Avenue under I-41
WIS 172 and I-41/WIS 172 Interchange

Brown County

  • Motorists should expect heavy congestion and potential long delays at the I-41/WIS 172 interchange and on WIS 172 in Brown County from I-43 to the WIS 172/I-41 interchange before and after the game. Motorists should consider alternate routes if possible.
I-41 mainline

Brown County

  • Drivers can expect slow-downs within the I-41 Project work zone between WIS 29 and Lineville Road. The speed limit is reduced to 55 mph in this area.

Winnebago County

  • Drivers will encounter reduced speed limits on I-41 near the US 10/WIS 441/I-41 interchange. Drivers should also watch for reduced lane widths and reduced shoulder widths on northbound and southbound I-41.
WIS 441, US 10 and Roland Kampo Bridge

Winnebago, Outagamie and Calumet counties

  • Drivers should be aware of orange barrels, narrow lanes, barrier walls and reduced speed limits.
  • US 10 eastbound between County CB and I-41 northbound is reduced to a single lane.
US 41, Oconto County
  • US 41 from US 141/US 41 split to the south end of Oconto may be reduced to one lane for US 41 resurfacing prior to Sunday.
  • Both lanes of southbound US 41 will be open on Sunday for Packer travel.
US 141, Marinette County
  • US 141 southbound is closed in the village of Wausaukee from WIS 180 to north village of Wausaukee limit. A detour using local streets is posted.

ALLOUEZ, WI (WTAQ) - State Representative David Steffen is asking Governor Scott Walker and the Wisconsin Department of Corrections to fund an analysis and study of the Green Bay Correctional Institution.

He wants to compare the costs of maintaining the over 100-year-old facility versus relocating and constructing a new prison.

He spoke at a press conference at the Allouez Village Hall Thursday, alongside Village President Jim Rafter.

"When we're putting $143 million into a 118 year old facility that has capacity issues, has control and carry issues...I think we need to be thinking seriously are we throwing the money in the wrong direction," says Steffen.

The representative says there's not a plan for maximum security inmates in the state of Wisconsin.

"When you are at capacity, there is nowhere else to go for these people. This is the end of the line when it comes to the criminal justice system," Steffen explains.

Rafter says something needs to be done.

"The issue of safety of our community, the issue of the safety of our employees, and the inmates needs to be addressed."

According to the letter Steffen sent Governor Walker, "a new facility would address costly capacity issues that all of Wisconsin's maximum security facilities are currently experiencing. Most importantly, this study would provide the data necessary to determine if taxpayer dollars are better spent continuing to maintain this aging facility or if construction of a new, modernized, multi-functional facility is more prudent."

In a statement released Thursday by the state Department of Corrections, communications director Tristan Cook said:

"The Department of Corrections is committed to the safety and security of staff and inmates in DOC custody. Secretary Litscher has visited GBCI several times to hear from front-line staff and leadership regarding GBCI and will continue to visit on a regular basis.DOC has submitted its biennial budget and capital budget requests to DOA for consideration, which include the department's priorities for the coming biennium.Among the proposals in the Capital Budget request related to GBCI are renovations to the North and South Cell Halls and the construction of a new Health Services Unit and Psychological Services Unit, both of which will increase safety for staff and inmates.Secretary Litscher looks forward to working with front-line staff and leadership at GBCI to continue identifying and implementing safety and security enhancements in the coming biennium."

The prison at 2833 Riverside Dr. houses roughly 1,000 offenders and is the second oldest maximum security prison in Wisconsin.

Bellin Health Facility Breaks Ground

ASHWAUBENON, WI (WTAQ) - A groundbreaking ceremony was held Thursday for the future site of Bellin Health's sports medicine clinic.

Together, we are having a positive impact on the quality of life in our community,” Mark Murphy, Packers president and CEO, said in a statement. “Bellin is known for delivering high quality healthcare and they’ve been a fantastic partner. We’re delighted to have this clinic be one of the initial tenants in the Titletown District.”

The clinic is one of three main anchors of the Green Bay Packers new Titletown District. The other two are Hinterland Restaurant and Brewery and Lodge Kohler.

This facility will serve as a destination for those in need of excellence in sports medicine,” said George Kerwin, Bellin Health president and CEO in a statement. “The most prominent aspect of our relationship with the Packers has been our shared desire to elevate the health and wellness of the community. This is an opportunity to share a magnificent sports medicine facility with athletes of all abilities.”

The new clinic will be a sports medicine facility specializing in injury prevention, treatment and therapy and performance improvement. Officials say it'll be a 52,000-square-foot facility, employing about 80 people.

The clinic will be staffed by longtime Packers team physician Dr. Patrick McKenzie, as well as Dr. Jim Ebben, Dr. James Spears, Dr. Gil Freeman and other sports medicine specialists. It will serve as a care location for Green Bay Packers players and the community at large.

Completion of Bellin’s facility, Lodge Kohler and Hinterland are slated to be complete by the start of the 2017 Packers Training Camp.

Last week, the Packers announced up to 10 acres of land within the district will be dedicated to a public park.
